License agreement with Vaelis Vaughan for sketches, drawings, designcomissions, free artworks, portraits and copies on third media, including cancellation policy and exclusion of the right of
cancellation for production orders.
1. Applicability of the license terms
1.1 Orders are produced exclusively on the basis of the following terms and conditions. These conditions also apply to all future production and license agreements, unless expressly agreed
otherwise. This license agreement is deemed to have been accepted once the order has been completed - regardless of whether the order was submitted via the Websiteshop, by phone, Whatsapp or e-mail.
Procedure: Before I start working on your order, you will receive a rough draft according to your ideas in advance for the levels of detail Comic Style, Semi-Realistic, Realistic, and all orders that have been individually agreed upon by e-mail. This can then be adjusted again so that you may receive a second draft. After I've completed the final job, I'll email you a compressed, digital preview for your final check. If you have additional requests for changes, up to 3 small touch-ups (e.g. shape of the nose, eyebrow position, fingernails or background details, other color nuances, etc.) are included in the price. After you have accepted the preview file, you will receive your order in the desired size/shape in the original/in full resolution and the order is complete.
Please note: Should you require more than the three drafts/minor changes included in the price or, after receiving the preview of the final order, additional extensions or major changes, this additional work will be charged at the usual hourly rate for arts and crafts (49€/hour). calculated at the agreed basic price. If there are additional costs, I will definitely let you know in advance, so that you always know what you will ultimately face financially!
1.2 Terms and conditions of the customer that deviate from the following conditions will not be recognized. Such deviating terms and conditions do not become part of the contract even if the
artist does not expressly object to them.
1.3 The conditions of the license agreement also apply. In the event of conflicting regulations, (1) the General Terms and Conditions, (2) the License Agreement shall take precedence.
2. Definition of terms
2.1 Images within the meaning of this contract are all commissioned drawings, artworks, portraits and images on third media (posters, etc.). The term covers all image products, regardless of the
creative stage or technical form (e.g. paper prints, digital images, etc.).
2.2 The order designates the contractual relationship between the artist Vaelis Vaughan and her client either for the production of pictures (production contract) and/or for the granting or
transfer of rights of use to pictures that have already been produced. The client is the customer who is named as such when the order is placed and who is shown as such on the invoice.
3. Subject of the contract / scope of copyright and usage rights
3.1
This contract is between the client and the artist. The subject of the contract is the order as it results from the order via the artist's website (www.vaelisvaughan.com).
3.2
The images created and/or offered for use by the artist are protected by copyright law. Any reproduction, distribution, exhibition and public reproduction of the images requires prior written
consent.
3.3
In principle, simple rights of use are granted for all purchased images! This means the buyer may:
- Show and use the picture in a private context (hang it up in the apartment, etc.)
- Take photos of the image and post it on any online platform (Facebook, Twitter, etc.) as long as the author credits Vaelis Vaughan (© by Vaelis Vaughan) and does not claim to be the
author.
- Editorial use is also permitted (i.e. an image may also be used as part of journalistic reporting.)
3.4
For orders for portraits of private individuals, pets, etc., based on the photo template sent by the buyer, the first license (simple rights of use) is automatically extended to the private
rights of use for portraits. These are:
- Buyer may scan, photograph, or use the digital medium to make non-commercial copies for friends and family of the custom made portrait.
- These copies may also be printed on paper, canvas, postcards, mugs, t-shirts or similar for the purpose of gifting to family and friends.
3.5
For orders for individual artworks, sketches and drawings according to specifications, the first license (simple rights of use) is automatically extended to the rights of use for free artworks.
These are:
- Buyer may scan, photograph, or use the digital medium to make non-commercial copies of the custom artwork at high resolution for anyone to see. The copyright owner and originator Vaelis Vaughan

- These copies may also be printed on paper, canvas, postcards, mugs, t-shirts or similar for the purpose of giving away and self-promotion, insofar as the copyright holder and originator Vaelis
Vaughan is named (© by Vaelis Vaughan) and the client is not himself claims to be the author.
- A logo, a company identifier, or a trademark of the buyer may be integrated. Likewise texts and specially invented picture titles. Apart from that, the artwork may not be altered in its origin,
or trimmed in such a way that the artist's signature is no longer visible. If you wish to edit the picture, you must first ask for the artist's written consent!
- The artwork may be used for a previously determined and agreed commercial product for sale (e.g. as a book cover, CD cover, advertising poster, tattoo template or postcard/mug/t-shirt etc.).
The copyright owner and originator Vaelis Vaughan, including the homepage, must always be named directly on the product (© by Vaelis Vaughan / HP: www.vaelisvaughan.com). If the buyer wishes
further commercial rights of use, he must acquire the necessary license from point 3.6.
3.6
Extended rights of use for drawings of any kind can be agreed at any time (also retrospectively)! These must also be requested by email, ordered with binding effect and notified.
- For another commercial product for sale 50.00€
- From five commercial products on sale, flat rate 250.00€ (unlimited)

without naming the originator for a price of plus €150 to be agreed.
4. Own use / self-promotion.
4.1
Irrespective of the extent of the rights of use granted in individual cases, the artist remains entitled to use and distribute the images in full within the scope of her own advertising, but not
to resell them (as a print or similar).
4.2
If the buyer does not want his provided photo template to be seen on the preview photo or a "work in progress" picture, he can inform the artist by e-mail when placing the order or during the
creation process. Otherwise, the consent of the artist is assumed (nude pictures or similar are of course an exception!). If the buyer sends an e-mail to understand that he does not want the
photo template to be shown, the painting can only be shown without it.
5. No Transfer of Ownership.
5.1 The customer only acquires rights of use to the contractually agreed extent. Ownership rights are not transferred.
6. Liability and Damages
6.1
Your statutory rights in the event of defects in the product are subject to the rules set out here.
6.2 the artist is only liable for damage caused by herself or her vicarious agents intentionally or through gross negligence. Excluded from this are damages resulting from the breach of a
contractual obligation that are of essential importance for the achievement of the purpose of the contract (cardinal obligations), as well as damages resulting from injury to life, limb or
health, for which the artist is liable even in the case of slight negligence.
6.3
the artist accepts no liability for the way in which her images are used. In particular, it is not liable for the admissibility of use under competition and trademark law.
6.4
Claims by the client resulting from a breach of duty by the artist or her vicarious agents expire one year after the start of the statutory limitation period. Excluded from this are claims for
damages based on an intentional or grossly negligent breach of duty by the artist or her vicarious agents, and claims for damages due to injury to life, limb or health, even if they are based on
a slightly negligent breach of duty by the artist or her vicarious agents; the statutory limitation periods apply to these claims for damages.
6.5
Images are sent at the client's risk.
6.6
In the event of unauthorized use, modification, redesign or transfer of an image - whether in conventional or digitized form - the artist is entitled to demand a contractual penalty of three
times the agreed usage fee or, in the absence of an agreement, three times the usual usage fee, but at least €1,000 per image and individual case. The assertion of a further claim for damages
remains unaffected.
6.7 If the artist is not named when an image is published or if the name is not permanently linked to the digital image, the customer must pay a contractual penalty of 100% of the agreed, or in
the absence of an agreement, the usual usage fee, but at least €300 per picture and individual case. the artist also reserves the right to assert a further claim for damages.
14. Right of Withdrawal
14.1
Returns can only be permitted in exceptional cases, since these are individual commissioned works that are sent to the customer by e-mail for a final check before they are finally dispatched.
14.2 Complaints about defects must be made in writing and received by the artist no later than two weeks after delivery of the picture. After this period has expired, the images are deemed to
have been accepted in accordance with the contract and are free of defects.
14.3 Insofar as the artist concludes contracts with third parties in the name and for the account of the customer, she is not liable for the services and work results of the persons and companies
commissioned.
14.4 Contractual warranty claims of the client due to material or legal defects in the images that have already been produced and that the artist makes available from her archive are
excluded.
14.5
A declaration of release issued by the artist does not include the assurance that the persons depicted and/or the owners of the rights to portrayed works of fine or applied art have given their
consent to the publication of the picture. Obtaining the consent of third parties or obtaining publication permits from collections, museums, etc. is the responsibility of the client, unless the
artist expressly assures that the necessary consent or approval has been obtained.
14.6 the artist accepts no liability for the way in which her images are used. The customer is responsible for ensuring that no personal rights, copyrights or other rights of third parties are
violated by the type of use.
15. Fees and Incidental Expenses
15.1 The artist receives the agreed fee for the production of the images and the transfer of the rights of use. All prices mentioned are net prices in euros and do not include statutory sales
tax.
19.2
The customer acquires the rights of use to be transferred only after full payment of the price.
16. Maturity and Methods of Payment
16.1 The total cost is due as soon as you receive the order confirmation.
16.2
You can choose from all payment methods offered during the ordering process.
17. Unavailability, Force Majeure
17.1 If the artist cannot deliver the product on time or at all due to unavailability of the materials or products for the production of the contractual product or due to force majeure, you will
be informed of this immediately and, if necessary, informed of the expected new delivery period. If delivery is impossible or if the new deadline cannot be met (e.g. due to an accident or
similar), the artist can withdraw from the contract. Your statutory right of withdrawal remains
unaffected, as well as the statutory provisions on the execution of the contract in the event of an exclusion of the obligation to perform (e.g. due to impossibility or unreasonableness).
17.2 The product is considered to be unavailable in particular if the third party commissioned with the delivery of materials does not deliver on time through no fault of the artist, although he
had concluded a congruent hedging transaction, i.e. a delivery order existed on the day of the order confirmation that objectively met the expectation allowed the artist to deliver the product as
agreed if everything went smoothly. Force majeure exists if an unforeseeable and extraordinary event! delays the delivery or makes it impossible and this cannot be avoided by the artist with
reasonable means; this can be the case, for example, in the case of strikes at the production site, accidents or storms on the transport routes.
18. Final Provisions
18.1 The nullity or ineffectiveness of individual GTC provisions does not affect the validity of the remaining provisions.
18.2 The law of the Federal Republic of Germany applies.
18.3 In the event that the client does not have a general place of jurisdiction in Germany or relocates his registered office or habitual residence abroad after the
conclusion of the contract, the artist's place of residence is agreed as the place of jurisdiction.
Lizenzvereinbarung mit Vaelis Vaughan für Skizzen, Design- und Grafikaufträge, Zeichnungen, freien Artworks, Portraits und Kopien auf dritten Medien, inklusive Widerrufsbelehrung sowie Ausschluss
des Widerrufsrechts von Produktionsaufträgen.
1. Geltung der Lizenzbedingungen
1.1 Die Produktion aller Aufträge erfolgt ausschließlich aufgrund nachstehender Geschäftsbedingungen. Diese Bedingungen gelten auch für alle zukünftigen Produktions– und Lizenzverträge, sofern
nicht ausdrücklich abweichende Regelungen vereinbart werden. Diese Lizenzvereinbarung gilt bei allen Bestellungen über den Shop, per Telefon, Whatsapp oder E-Mail als anerkannt!
Ablauf: Bevor ich mit der Arbeit an deinem Auftrag beginne, bekommst du bei den Detailgraden Comic-Style, Semi-Realistic, Realistic, und allen Aufträgen, die individuell per
E-Mail abgesprochen wurden, auf Wunsch einen groben Entwurf nach deinen Vorstellungen vorab. Dieser kann dann noch einmal angepasst werden, sodass du ggf. einen zweiten Entwurf erhältst. Nach
meiner Fertigstellung des finalen Auftrags schicke ich dir eine komprimierte, digitale Vorschau per E-Mail, zur letzten Kontrolle. Wenn du dazu noch Änderungswünsche hast, sind bis zu 3 kleine
Nacharbeiten (zbsp. Form der Nase, Augenbrauenhaltung, Fingernägel oder Hintergrunddetails, andere Farbnuancen uä.) im Preis enthalten. Nach deiner Abnahme der Vorschaudatei erhältst du deinen
Auftrag in der gewünschten Größe/Form im Original / in Vollauflösung und der Auftrag ist abgeschlossen.
Bitte beachte: Solltest du mehr als die im Preis enthaltenen drei Entwürfe/kleinen Änderungen oder, nach Erhalt der Vorschau des finalen Auftrages, zusätzliche Erweiterungen oder
große Abänderungen wünschen, so wird diese Mehrarbeit nach dem gängigen Stundenlohn für Kunsthandwerk (49€/Stunde) zusätzlich zum vereinbarten Grundpreis berechnet. Sollten zusätzliche Kosten
entstehen, gebe ich dir aber in jedem Fall vorher Bescheid, sodass du immer weißt, was letztendlich finanziell auf dich zukommt!
1.2 Geschäftsbedingungen des Auftraggebers, die von den nachstehenden Bedingungen abweichen, werden nicht anerkannt. Solche abweichenden Geschäftsbedingungen werden auch dann nicht
Vertragsinhalt, wenn die Künstlerin ihnen nicht ausdrücklich widerspricht.
1.3 Daneben gelten die Bedingungen des Lizenzvertrags. Vorrang der Geltung bei sich widersprechenden Regelungen haben (1) die AGB, (2) die Lizenzvereinbarung.
2. Begriffsbestimmung
2.1 Bilder im Sinne dieses Vertrages sind alle Auftragszeichnungen, Artworks, Portraits und Bilder auf dritten Medien (Poster etc.). Der Begriff erfasst alle Bilderzeugnisse, gleich in welcher
Schaffensstufe oder in welcher technischen Form (zum Beispiel Papierabzüge, digitale Bilder etc.).
2.2 Der Auftrag bezeichnet das Vertragsverhältnis zwischen der Künstlerin Vaelis Vaughan und ihrem Auftraggeber entweder zur Herstellung von Bildern (Produktionsvertrag) und / oder über die
Einräumung bzw. übertragung von Nutzungsrechten an bereits hergestellten Bildern. Auftraggeber ist der Kunde, welcher bei der Bestellung als solcher benannt und in der Rechnung als solcher
ausgewiesen wird.
3. Vertragsgegenstand / Umfang der Urheber- und Nutzungsrechte
3.1
Dieser Vertrag gilt zwischen dem Auftraggeber und der Künstlerin. Gegenstand des Vertrags ist der Auftrag wie er sich aus der Bestellung über die Homepage der Künstlerin (www.vaelisvaughan.com)
ergibt.
3.2
Die von der Künstlerin hergestellten und / oder zur Nutzung angebotenen Bilder sind durch das Urheberrechtsgesetz geschützt. Jede Vervielfältigung Verbreitung, Ausstellung und öffentliche
Wiedergabe der Bilder bedarf der vorherigen schriftlichen Einwilligung.
3.3
Grundsätzlich werden an allen erworbenen Bildern einfache Nutzungsrechte eingeräumt! Dies bedeutet, der Käufer darf:
- Das Bild im privaten Rahmen zeigen und verwenden (in der Wohnung aufhängen etc.)
- Fotos von dem Bild machen und es auf Online Plattformen jeder Art zeigen (Facebook, Twitter etc.) solange er die Urheberin Vaelis Vaughan benennt (© by Vaelis Vaughan) und sich nicht selbst als
Urheber ausgibt.
- Auch die Redaktionelle Nutzung ist erlaubt (das heißt, ein Bild darf auch im Rahmen einer journalistischen Berichterstattung verwendet werden.)
3.4
Bei Aufträgen zu Portraits von Privatpersonen, Haustieren etc., nach vom Käufer zugesendeter Fotovorlage, erweitert sich die erste Lizenz (einfache Nutzungsrechte) automatisch auf die Privaten
Nutzungsrechte für Portraits. Diese sind:
- Der Käufer darf das individuell für ihn angefertigte Portrait hochauflösend einscannen, abfotografieren oder das digitale Medium verwenden, um nicht-kommerzielle Kopien für Freunde und Familie
anzufertigen.
- Diese Kopien dürfen für den Zweck des Verschenkens an Familie und Freunde auch auf Papier, Leinwand, Postkarten, Tassen, Tshirts oder ähnlichem gedruckt werden.
3.5
Bei Aufträgen zu individuellen Artworks, Skizzen und Zeichnungen nach Vorgabe, erweitert sich die erste Lizenz (einfache Nutzungsrechte) automatisch auf die Nutzungsrechte für freie Artworks.
Diese sind:
- Der Käufer darf das individuell für ihn angefertigte Artwork hochauflösend einscannen, abfotografieren oder das digitale Medium verwenden, um nicht-kommerzielle Kopien für jedermann
anzufertigen. Die Copyrightsinhabern und Urheberin Vaelis Vaughan ist dabei immer zu benennen. (© by Vaelis Vaughan)
- Diese Kopien dürfen für den Zweck des Verschenkens und der Eigenwerbung auch auf Papier, Leinwand, Postkarten, Tassen, Tshirts oder ähnlichem gedruckt werden, insofern die Copyrightsinhabern
und Urheberin Vaelis Vaughan darauf benannt wird (© by Vaelis Vaughan) und der Auftraggeber sich nicht selbst als Urheber ausgibt.
- Ein Logo, ein Unternehmenskennzeichen, oder eine Marke des Käufers darf eingebunden werden. Ebenso Texte und eigens erfundene Bildtitel. Davon abgesehen darf das Artwork in seinem Ursprung
nicht verändert, oder so beschnitten werden, das die Unterschrift der Künstlerin nicht mehr sichtbar ist. Sollte eine Bearbeitung des Bildes gewünscht sein, muss vorher um schriftliche
Einwilligung der Künstlerin gebeten werden!
- Das Artwork darf für ein vorher bestimmtes und vereinbartes kommerzielles Produkt zum Verkauf genutzt werden (Zum Beispiel als Buchcover, CD-Cover, Werbeplakat, Tattoovorlage oder
Postkarte/Tasse/Tshirt etc.). Die Copyrightsinhabern und Urheberin Vaelis Vaughan ist auch hierbei immer, inklusive der Homepage, direkt auf dem Produkt zu benennen (© by Vaelis Vaughan / HP:
www.vaelisvaughan.com). Wünscht der Käufer weitere kommerzielle Nutzungsrechte, so muss er dafür die erforderliche Lizenz aus Punkt 3.6 erwerben.
3.6
Erweiterte Nutzungsrechte für Zeichnungen jeder Art können jederzeit (auch nachträglich) vereinbart werden! Diese müssen zusätzlich per Email angefordert, verbindlich bestellt und
hornoriert werden.
- Für ein weiteres kommerzielles Produkt zum Verkauf 50,00€
- Ab fünf kommerziellen Produkten zum Verkauf, pauschal 250,00€ (unbegrenzt)
Die Copyrightsinhabern und Urheberin Vaelis Vaughan ist auch hierbei immer, inklusive der Homepage, direkt auf dem Produkt zu benennen (© by Vaelis Vaughan / HP: www.vaelisvaughan.com) Der
Verkauf von Produkten ohne Benennung der Urheberin kann für den Preis von zzgl. 150€ vereinbart werden.
4. Eigene Verwendungsmöglichkeit / Eigenwerbung.
4.1
Ungeachtet des Umfangs der im Einzelfall eingeräumten Nutzungsrechte bleibt die Künstlerin berechtigt, die Bilder im Rahmen ihrer Eigenwerbung vollumfänglich zu verwenden und zu verbreiten,
jedoch nicht weiter zu verkaufen (als Print oä.).
4.2
Sollte der Käufer nicht wünschen, dass seine bereitgestellte Fotovorlage auf dem Vorschaufoto oder einem "work in progress" Bild zu sehen ist, kann er dies der Künstlerin per E-Mail bei
Auftragserteilung oder auch noch im Entstehungsprozess mitteilen. Das Einverständnis wird andernfalls seitens der Künstlerin vorausgesetzt (Aktbilder oder ähnliches bilden hierbei
selbstverständlich eine Ausnahme!). Gibt der Käufer per E-Mail zu verstehen, dass er die Fotovorlage nicht mit abgebildet haben möchte, so kann das Gemälde lediglich ohne diese gezeigt
werden.
5. Keine Übertragung von Eigentumsrechten.
5.1 Der Auftraggeber erwirbt an den Bildern nur Nutzungsrechte im vertraglich festgelegten Umfang. Eigentumsrechte werden nicht übertragen.
6. Haftung und Schadenersatz
6.1
Ihre gesetzlichen Rechte im Falle von Mängeln des Produktes bestehen unter Maßgabe der hier aufgeführten Regeln.
6.2 die Künstlerin haftet nur für Schäden, die sie selbst oder ihre Erfüllungsgehilfen vorsätzlich oder grob fahrlässig herbeiführen. Davon ausgenommen sind Schäden aus der Verletzung einer
Vertragspflicht, die für die Erreichung des Vertragszwecks von wesentlicher Bedeutung sind (Kardinalpflichten), sowie Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit, für
die die Künstlerin auch bei leichter Fahrlässigkeit haftet.
6.3
die Künstlerin übernimmt keine Haftung für die Art der Nutzung ihrer Bilder. Insbesondere haftet sie nicht für wettbewerbs- und markenrechtliche Zulässigkeit der Nutzung.
6.4
Ansprüche des Auftraggebers, die sich aus einer Pflichtverletzung der Künstlerin oder ihrer Erfüllungsgehilfen ergeben, verjähren ein Jahr nach dem gesetzlichen Verjährungsbeginn. Davon
ausgenommen sind Schadensersatzansprüche, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung der Künstlerin oder seiner Erfüllungsgehilfen beruhen, und Schadenersatzansprüche
wegen Verletzung des Lebens, des Körpers oder der Gesundheit, auch soweit sie auf einer leicht fahrlässigen Pflichtverletzung der Künstlerin oder ihrer Erfüllungsgehilfen beruhen; für diese
Schadenersatzansprüche geltend die gesetzlichen Verjährungsfristen.
6.5
Die Zusendung von Bildern erfolgt auf Gefahr des Auftraggebers.
6.6
Bei unberechtigter Nutzung, Veränderung, Umgestaltung oder Weitergabe eines Bildes – gleich ob in herkömmlicher oder digitalisierter Form – ist die Künstlerin berechtigt, eine Vertragsstrafe in
Höhe des dreifachen vereinbarten oder, mangels Vereinbarung, des dreifachen üblichen Nutzungshonorars zu fordern, mindestens jedoch 1.000 € pro Bild und Einzelfall. Die Geltendmachung eines
weitergehenden Schadensersatzanspruchs bleibt unberührt.
6.7 Unterbleibt bei einer Bildveröffentlichung die Benennung der Künstlerin oder wird der Name mit dem digitalen Bild nicht dauerhaft verknüpft, so hat der Auftraggeber eine Vertragsstrafe in
Höhe von 100 % des vereinbarten, oder mangels Vereinbarung, des üblichen Nutzungshonorars zu zahlen, mindestens jedoch 300 € pro Bild und Einzelfall. der Künstlerin bleibt auch insoweit die
Geltendmachung eines weitergehenden Schadensersatzanspruchs vorbehalten.
14. Widerrufsrecht
14.1
Die Rückgabe kann nur in Ausnahmefällen gestattet werden, da es sich um individuelle Auftragsarbeiten handelt, die dem Kunden vor dem endgültigen Versand per E-mail zur letzten Kontrolle
zugeschickt wird. 14.2 Mängelrügen müssen schriftlich erfolgen und spätestens zwei Wochen nach Ablieferung des Bildes bei der Künstlerin eingegangen sein. Nach Ablauf dieser Frist gelten die
Bilder als vertragsgemäß und mängelfrei abgenommen.
14.3 Soweit die Künstlerin im Namen und für Rechnung des Auftraggebers Verträge mit Dritten abschließt, haftet sie nicht für die Leistungen und Arbeitsergebnisse der beauftragten Personen und
Unternehmen.
14.4 Vertragliche Gewährleistungsansprüche des Auftraggebers wegen Sach- oder Rechtsmängeln der Bilder, die bereits hergestellt sind und die die Künstlerin aus ihrem Archiv zur Verfügung stellt,
sind ausgeschlossen.
14.5
Eine von der Künstlerin erteilte Freigabeerklärung beinhaltet nicht die Zusicherung, dass abgebildete Personen und oder die Inhaber der Rechte an portraitierten Werken der bildenden oder
angewandten Kunst die Einwilligung zu einer Bildveröffentlichung erteilt haben. Die Einholung der Einwilligung Dritter oder die Erwirkung von Veröffentlichungs-genehmigungen bei Sammlungen,
Museen etc. obliegt dem Auftraggeber, sofern nicht die Künstlerin das Vorliegen der erforderlichen Einwilligung bzw. Genehmigung ausdrücklich zusichert.
14.6 die Künstlerin übernimmt keine Haftung für die Art die Nutzung ihrer Bilder. Der Auftraggeber ist dafür verantwortlich, dass durch die Art der Nutzung keine Persönlichkeitsrechte,
Urheberrechte oder sonstige Rechte Dritter verletzt werden.
15. Honorar und Nebenkosten
15.1 Für die Herstellung der Bilder und die übertragung der Nutzungsrechte erhält die Künstlerin das vereinbarte Honorar. Alle genannten Preise sind Nettopreise in Euro und enthalten keine
gesetzliche Umsatzsteuer.

Die zu übertragenen Nutzungsrechte erwirbt der Auftraggeber erst mit der vollständigen Zahlung des Preises.
16. Fälligkeit und Zahlungsarten
16.1 Die Gesamtkosten sind fällig, sobald Sie die Bestellbestätigung erhalten.
16.2
Sie können unter allen beim Bestellvorgang angebotenen Zahlungsarten wählen.
17. Nichtverfügbarkeit, höhere Gewalt
17.1 Wenn die Künstlerin wegen Nichtverfügbarkeit der Materialien oder Produkte zur Herstellung des Vertragsgegenstands Produktes oder wegen höherer Gewalt das Produkt nicht rechtzeitig oder gar
nicht liefern kann, werden Sie hierüber unverzüglich informiert und Ihnen ggf. die voraussichtliche neue Lieferfrist mitgeteilt. Ist die Lieferung unmöglich oder kann auch die neue Frist
nicht eingehalten werden (zbsp. durch einen Unfall oä.), kann die Künstlerin vom Vertrag zurücktreten. Ihr gesetzliches Rücktrittsrecht bleibt
unberührt, ebenso wie die gesetzlichen Vorschriften über die Abwicklung des Vertrags bei einem Ausschluss der Leistungspflicht (z.B. wegen Unmöglichkeit oder Unzumutbarkeit).
17.2 Das Produkt gilt insbesondere dann als nicht verfügbar, wenn der mit der Lieferung von Materialien beauftragte Dritte ohne das Verschulden der Künstlerin nicht rechtzeitig liefert, obwohl er
ein kongruentes Deckungsgeschäft abgeschlossen hatte, d.h. am Tag der Bestellbestätigung ein Lieferauftrag bestand, der objektiv gesehen die Erwartung zuließ, dass die Künstlerin daraus bei
reibungslosem Ablauf das Produkt wie vereinbart werde liefern können. Höhere Gewalt liegt vor, wenn ein unvorhersehbares und außergewöhnliches Ereignis!die Lieferung verzögert oder unmöglich
macht und dies durch die Künstlerin nicht mit zumutbaren Mitteln vermieden werden kann; dies kann beispielsweise bei Streiks am Produktionsort, Unfällen oder Unwettern auf den Transportwegen der
Fall sein.
18. Schlussbestimmungen
18.1 Die Nichtigkeit oder Unwirksamkeit einzelner AGB Bestimmungen berührt die Gültigkeit der übrigen Bestimmungen nicht.
18.2 Es gilt das Recht der Bundesrepublik Deutschland.
18.3 Für den Fall dass der Auftraggeber über keinen allgemeinen Gerichtsstand in Deutschland verfügt oder seinen Sitz oder seinen gewöhnlichen Aufenthalt nach Vertragsschluss ins Ausland verlegt,
wird der Wohnsitz der Künstlerin als Gerichtsstand vereinbart.
